Terms of Service

1. Description of service

Elite Football Mentoring provides video-based football mentoring services. Our service consists of the review and tactical analysis of match footage submitted by or on behalf of the registered player, conducted live or asynchronously via video call by an assigned EFM mentor.

The service is educational and analytical in nature. It does not constitute physical training, medical advice, nutritional guidance, or any guarantee of athletic performance improvement or professional contract placement.

1.1 Individual mentoring plans

EFM offers individual mentoring plans, each operating on a monthly subscription basis. Plans differ in the level of mentoring involvement and may include some or all of the following:

• Professional (PRO) video analysis of submitted match footage with actionable improvement points.
• Face-to-face video call sessions with the assigned mentor.
• Full comprehensive weekly monitoring — including post-match performance surveys, PRO video analysis, face-to-face video calls, and tailored individual match plan reports.

Specific plan features and pricing are communicated during the introductory consultation call. EFM reserves the right to modify plan features and pricing in accordance with Section 6 below.

1.2 Teams & academies service

EFM also provides tailored mentoring programmes forteams, clubs, and academies seeking multi-player mentoring packages. The Teams & Academies service operates on an enquiry basis: the organisation submits an enquiry through our website, and our team arranges a discovery call to discuss scope, objectives, number of players, scheduling, and pricing. A bespoke agreement is then drawn up reflecting the terms agreed during that call.

Unless the bespoke agreement states otherwise, all general provisions of these Terms also apply to the Teams & Academies service.

2. Eligibility & registration

The service is available to players aged 16 years or older. Where the registered player is aged 16 or 17, a parent or legal guardian must complete the registration form, provide consent, and act as the primary point of contact throughout the programme.

By registering, the person submitting the form represents and warrants that:

• All information provided is accurate and complete.
• If registering on behalf of a minor, they are that minor's parent or legal guardian.
• They have the legal authority to enter into these Terms.

3. Footage & data authorisation

By registering you explicitly authorise EFM to:

• Receive and store match footage or other video material submitted for analysis.
• Share that footage with the assigned mentor and EFM's video production team solely for the purpose of preparing and delivering the mentoring session. Video editing may be delegated to external editors who are not EFM employees; in such cases, those editors are only granted access to footage strictly necessary for their editing task.
• Retain session recordings (where applicable) for quality-assurance purposes for a maximum of 90 days after the session date, unless you request earlier deletion.

Footage will never be shared publicly, sold, or disclosed to any third party outside EFM without your explicit written consent, except where required by applicable law.

4. Open door policy

Parents and legal guardians are always welcome and encouraged to be present during any live video mentoring session. It is the responsibility of the registering guardian to arrange their own availability. Sessions may be rescheduled with at least 24 hours' notice if the guardian cannot attend and wishes to do so.

5. Payments & cancellations

Payment terms and session pricing are communicated during the welcome call that follows registration. EFM reserves the right to modify pricing with 14 days' notice for existing clients.

Cancellations made with less than 24 hours' notice may result in forfeiture of the scheduled session without a refund. EFM will make reasonable efforts to reschedule sessions cancelled by us.

6. Subscription & billing

6.1 Individual plans

Individual mentoring plans are billed on a monthly subscription basis. Your subscription automatically renews at the beginning of each billing cycle unless you cancel before the renewal date. Plan upgrades or downgrades requested mid-cycle will take effect at the start of the next billing cycle.

6.2 Teams & academies

Teams & Academies clients are invoiced according to the terms set out in their bespoke agreement. Payment terms, schedules, and refund conditions are specified in that agreement.

6.3 EU consumer withdrawal right

If you are a consumer located in the European Unionor the European Economic Area (EEA), you have the right to withdraw from your subscription within14 calendar days from the date of your first subscription payment, without giving any reason, in accordance with Directive 2011/83/EU. To exercise this right, please contact us at info@elitefootballmentoring.com with a clear statement of your decision to withdraw. If you have already received services during the withdrawal period, you may be charged a proportionate amount for the services provided up to the date of withdrawal.

7. Disclaimer of warranties

EFM's mentoring is provided on an "as is" basis for educational and tactical analysis purposes only. We make no representation or warranty that:

• The service will produce specific athletic results or improve performance metrics.
• Participation will lead to professional contracts, trial opportunities, or team selection.
• The service is a substitute for physical coaching, medical evaluation, or injury rehabilitation.

8. Limitation of liability

To the fullest extent permitted by applicable law, EFM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service. Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you for the relevant session or, for subscription clients, the fees paid during the month in which the claim arose.

Nothing in these Terms excludes or limits liability that cannot be lawfully excluded or limited under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

9. Acceptable Use

You agree not to:

• Record, redistribute, or publish any session content without EFM's prior written consent.
• Use the service for any unlawful, harassing, or abusive purpose.

10. Teams & academies — specific terms

The following additional terms apply specifically to organisations (teams, clubs, and academies) that engage EFM through the Teams & Academies service:

• Authority: The contact person who submits the enquiry on behalf of the organisation represents and warrants that they are duly authorised by the organisation to do so and to share the contact information provided in the enquiry form.
• Player Data Responsibility: The organisation is responsible for obtaining valid consent (or identifying another lawful basis under applicable data protection law) from each player — or from each player's parent or legal guardian if the player is a minor — before sharing the player's personal data or match footage with EFM.
• Data Controller / Data Processor:When EFM provides services to a team or academy, theorganisation acts as the data controllerfor the personal data of its players, andEFM acts as a data processor, processing player data only as instructed by the organisation and within the scope of the agreed service terms.
• Bespoke Agreement: All commercial terms (scope, number of players, pricing, scheduling, and payment) will be documented in a bespoke written agreement between EFM and the organisation. In the event of a conflict between these Terms and the bespoke agreement, the bespoke agreement shall prevail for the matters it specifically addresses.

11. Changes to these terms

EFM reserves the right to update these Terms at any time. Material changes will be communicated via email to the registered contact address at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

12. Governing law & jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Spain.

For users located in the European Union / EEA: nothing in these Terms affects your mandatory consumer protection rights under the laws of your country of residence. You may bring proceedings in the courts of your habitual residence or in the courts of Madrid, Spain.

For users located in the United States: disputes arising under these Terms shall be governed by Spanish law, without prejudice to any mandatory consumer rights under the laws of your state of residence. Subject to applicable law, the courts of Madrid, Spain shall have jurisdiction, except where mandatory consumer forum rules apply.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
